AGREEMENT TO OUR LEGAL TERMS

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you and Toast Tours LLC (“Toast Tours,” “we,” “us,” or “our”), a California limited liability company.

These Terms govern your access to and use of our website (https://www.toasttours.com), as well as any bookings, tours, communications, or related services we provide (collectively, the “Services”).

By booking a tour, accessing our Services, or otherwise engaging with Toast Tours, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our Services.

We recommend that you print a copy of these Legal Terms for your records.

IMPORTANT NOTICE REGARDING DISPITE RESOLUTION

THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

These Terms include a binding arbitration provision and waiver of class actions, which affect your legal rights. Please review the Dispute Resolution (Arbitration) section carefully.

ELIGIBILITY

Our Services are intended for individuals who are at least 18 years old. By using our Services, you represent that you meet this requirement.

SERVICES

Toast Tours provides curated tour experiences, including transportation, itinerary planning, and visits to independent third-party venues such as wineries, breweries, distilleries, restaurants, and other destinations.

All services are subject to availability, operating conditions, and third-party provider policies.

Toast Tours reserves the right, in its sole discretion, to modify itineraries, vehicles, routes, schedules, and destinations as necessary to ensure safety, timing, logistics, and overall guest experience.

Specific venues, stops, or experiences are not guaranteed unless expressly confirmed in writing by Toast Tours. Substitutions of equal quality or similar experience may be made when necessary.

Toast Tours may utilize third-party operators, subcontractors, or affiliate partners to provide transportation or services as needed.

Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

Toast Tours disclaims all warranties, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose.

BOOKINGS & PAYMENTS

A deposit or full payment is required to secure your booking. Bookings are not confirmed until accepted by Toast Tours.

You agree to provide current, complete, and accurate payment and contact information and to promptly update such information as needed.

By submitting payment, you authorize Toast Tours to charge your selected payment method for all applicable charges, including agreed fees, additional services, and any applicable taxes.

Pricing is subject to change until a booking is confirmed. Toast Tours reserves the right to correct pricing errors at any time, including after payment has been requested or received.

Additional charges may apply for:

  • Extended hours or overtime
  • Itinerary changes
  • Special requests
 

Toast Tours reserves the right to refuse or cancel any booking in its sole discretion, including in cases of suspected fraud, misuse, or violation of these Terms.

All payments are processed in U.S. dollars.

Payment Disputes & Chargebacks

To the fullest extent permitted by law, by completing a booking, you agree not to initiate a chargeback or payment dispute with your credit card provider or bank except in cases of fraud or unauthorized use.

In the event of a dispute, you agree to first contact Toast Tours directly to seek resolution.

If a chargeback or payment dispute is initiated in violation of these Terms, you agree that:

  • Toast Tours may provide these Terms, booking records, communications, and service details to the payment processor as evidence
  • You remain responsible for any amounts owed for services rendered
  • You will be responsible for any fees, costs, or expenses (including administrative and collection costs) incurred by Toast Tours in responding to or resolving the dispute
 

Toast Tours reserves the right to pursue collection of unpaid balances through appropriate means, including third-party collection agencies or legal action where permitted by law.

CANCELLATIONS & REFUNDS

All bookings are subject to Toast Tours’ Pricing and Cancellation Policy.

By booking a tour, you acknowledge that you have read and agree to this policy, which is incorporated into these Terms by reference.

The Pricing and Cancellation Policy governs:

  • Cancellation timelines
  • Refund eligibility
  • Rescheduling terms
  • Fees and penalties
 

In the event of any conflict between these Terms and the Pricing and Cancellation Policy, the Pricing and Cancellation Policy shall control with respect to cancellations, refunds, and rescheduling.

Toast Tours reserves the right to enforce the applicable cancellation policy as written. No refunds will be issued except as expressly provided in the Pricing and Cancellation Policy.

The policy in effect at the time of booking shall govern.

GUEST RESPONSIBILITY

By participating in a Toast Tours experience, you agree to:

  • Arrive on time for all scheduled pick-ups and activities
  • Follow all instructions from your host or driver
  • Comply with all applicable laws and the policies of each venue visited
  • Treat all vehicles, venues, staff, and other guests with respect
 

Guests are responsible for selecting a tour that is appropriate for their abilities, mobility, and personal needs. Guests are responsible for ensuring they are physically and medically fit to participate. Tour activities may include, but are not limited to, walking, standing for extended periods, navigating uneven surfaces, and entering and exiting vehicles.

Guests are responsible for any damage they cause to vehicles, venues, or third-party property.

Guests are expected to act responsibly at all times, including with respect to alcohol consumption. Alcohol consumption is voluntary and at your own risk. You are solely responsible for your consumption and behavior during and after the tour. Toast Tours does not monitor or control alcohol consumption.

Guests who consume alcohol must be at least 21 years of age and may be required to present valid government-issued identification. Guests under the age of 21 are permitted to participate but may not consume alcohol under any circumstances. Service of alcohol is at the sole discretion of each venue, and Toast Tours is not responsible for any decision by a venue to refuse service to any guest.

Guests must comply with all applicable laws and are responsible for ensuring they are legally permitted to consume alcohol. Toast Tours strongly advises that guests who consume alcohol do not operate a vehicle following the tour and arrange safe transportation to their accommodations.

Any guest under the age of 18 must be accompanied by a parent, legal guardian, or responsible adult. The accompanying adult assumes full responsibility for the minor’s supervision, safety, and conduct throughout the tour.

Guests are responsible for managing their personal needs, including dietary restrictions, allergies, and health considerations. Toast Tours is not responsible for any adverse reactions to food, beverages, or environmental conditions encountered during the tour.

Late arrivals may result in reduced tour time or missed experiences. No refunds or credits will be issued for late arrivals.

Toast Tours reserves the right, in its sole discretion, to refuse service or remove any guest from a tour without refund if their behavior is unsafe, disruptive, illegal, or negatively impacts the experience of others, including but not limited to intoxication.

DAMAGE & CLEANING

You are responsible for any damage to or excessive cleaning required for any vehicle resulting from your actions or the actions of any member of your party.

You expressly authorize Toast Tours to charge the credit card on file for any such damage, cleaning, or related costs.

Damage and cleaning may include, but are not limited to: burns, spillage, vomiting, broken glassware, scratches, stains, and damage to windows, seats, mirrors, vents, or other vehicle components.

A minimum cleaning fee of $350 will be charged for the presence of prohibited materials such as glitter or feathers (including boas), which are strictly not allowed in vehicles. This fee represents a reasonable estimate of the cost required to restore the vehicle to service.

Additional charges may apply for actual repair costs, professional cleaning, and loss of use of the vehicle during repair or cleaning.

All determinations regarding damage, cleaning, and associated charges shall be made by Toast Tours in its reasonable discretion and may be supported by photographs or other documentation.

If the credit card on file cannot be charged, you agree to remit payment within seven (7) calendar days. The booking party is jointly and severally responsible for all such charges.

Smoking is strictly prohibited in all vehicles. Additional cleaning or damage fees may apply for violations.

Animals are not permitted on shared group tours, except for legally recognized service animals.

ACCESSIBILITY & FITNESS TO PARTICIPATE

Toast Tours strives to provide welcoming and inclusive experiences for all guests. However, due to the nature of our vehicles, partner venues, and tour environments, certain aspects of our Services may not be fully accessible.

Tour activities may include, but are not limited to, walking, standing for extended periods, navigating uneven surfaces, stairs, and entering and exiting vehicles. Guests are responsible for selecting a tour that is appropriate for their abilities, mobility, and personal needs.

Guests with mobility limitations, disabilities, or other accessibility needs are encouraged to contact Toast Tours prior to booking so that we may provide information about potential limitations and discuss reasonable accommodations where feasible.

While Toast Tours will make reasonable efforts to accommodate guests with disabilities in accordance with applicable law, including the Americans with Disabilities Act (ADA), we do not guarantee that all accommodations or requests can be met, particularly where limitations are imposed by third-party venues, vehicle configurations, or safety considerations.

Guests are responsible for assessing their ability to participate safely in the tour, including, without limitation, mobility, medical, or other conditions that may affect participation. Toast Tours reserves the right to decline participation or modify arrangements if, in its reasonable judgment, participation would pose a safety risk to the guest or others.

DIETARY & ALLERGEN CONSIDERATIONS

Toast Tours partners with independent third-party venues, including wineries, breweries, distilleries, and restaurants.

While guests are welcome to share dietary preferences or allergies in advance, Toast Tours cannot guarantee that all requests can be accommodated at each location. Guests are responsible for communicating any dietary restrictions or allergies directly to each venue at the time of service.

Food and beverages may contain or come into contact with common allergens, including but not limited to dairy, eggs, wheat, gluten, soy, peanuts, tree nuts, fish, shellfish, sesame, and sulfites. Cross-contact may occur, and environments may not be allergen-free.

Guests are solely responsible for managing their dietary needs and associated risks. Toast Tours is not responsible for any allergic reactions, sensitivities, or adverse health effects resulting from food, beverages, or environmental conditions encountered during the tour, including severe or life-threatening allergic reactions.

TRANSPORTATION & DELAYS

Guests must follow all vehicle safety rules, including seatbelt use where required by law.

Toast Tours strives to operate all tours as scheduled; however, timing and itineraries may be affected by factors outside of our control, including but not limited to:

  • Traffic conditions
  • Weather
  • Road closures or hazards
  • Delays at venues
  • Guest punctuality
 

As a result, itineraries, routes, timing, and duration of stops may be adjusted as necessary.

Toast Tours is not liable for delays, shortened visits, or missed experiences resulting from these factors.

THIRD-PARTY PROVIDERS

Toast Tours partners with and may recommend independent third-party providers, including wineries, breweries, distilleries, restaurants, and other venues.

These providers operate independently and are solely responsible for their own services, including but not limited to operations, pricing, availability, safety, and policies.

Toast Tours does not own, control, or manage any third-party providers and makes no representations or warranties regarding their services, experiences, or availability.

Any links to third-party websites or services are provided for convenience only. Toast Tours is not responsible for the content, accuracy, or practices of any third-party websites.

Guests acknowledge that experiences at third-party venues may vary and are subject to change without notice. Toast Tours is not liable for any acts, omissions, delays, service issues, or changes related to third-party providers.

Guests are subject to the terms, conditions, and policies of each third-party provider.

Nothing in these Terms creates any partnership, joint venture, or agency relationship between Toast Tours and any third-party provider.

FORCE MAJEURE

Toast Tours shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:

  • Weather conditions
  • Wildfires, earthquakes, or other natural disasters
  • Road closures or infrastructure issues
  • Government actions or restrictions
  • Public health events
  • Labor shortages, strikes, or utility failures
  • Third-party vendor availability
 

In such circumstances, Toast Tours reserves the right, in its sole discretion, to modify, substitute, reschedule, or cancel any portion of the Services as necessary.

Toast Tours will make reasonable efforts to provide comparable alternatives or reschedule affected services; however, refunds or credits, if any, will be determined in accordance with the Pricing and Cancellation Policy.

ASSUMPTION OF RISK & RELEASE OF LIABILITY

Participation in tour activities involves inherent risks, including transportation, alcohol consumption, and visits to third-party locations.

To the fullest extent permitted by California law:

  • You voluntarily assume all risks associated with participation, including risks that are known and unknown, foreseeable and unforeseeable.
  • You agree to release, waive, and discharge Toast Tours, its owners, employees, contractors, and affiliates from any and all liability for injury, loss, or damage arising out of or related to your participation, except where caused by gross negligence or willful misconduct.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Toast Tours’ total liability to you for any claims arising out of or relating to the Services is limited to the total amount paid by you for the applicable booking.

Toast Tours shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of enjoyment, missed experiences, or travel disruptions, even if advised of the possibility of such damages.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Toast Tours, its owners, employees, contractors, affiliates, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your participation in or use of the Services
  • Your violation of these Terms
  • Your negligence, misconduct, or violation of law
  • Your violation of the rights of any third party

Toast Tours reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with the defense of such claims.

INTELLECTUAL PROPERTY

All itineraries, recommendations, tour designs, and related materials provided by Toast Tours, as well as all content created or published by Toast Tours across its website, social media platforms, marketing channels, and communications—including photographs, videos, branding elements, logos, and written materials (collectively, the “Content”)—are proprietary and developed through Toast Tours’ expertise, relationships, and experience.

The Content is provided solely for your personal, non-commercial use in connection with your experience with Toast Tours.

You may not, without prior written consent:

  • Copy, reproduce, distribute, publish, or share the Content
  • Use the Content for commercial purposes or to create a competing service
  • Input, upload, transmit, or otherwise use the Content, in whole or in part, in any artificial intelligence system, model, or tool, or use the Content to train, fine-tune, inform, or generate similar itineraries, recommendations, or services

You may not use Toast Tours’ name, trademarks, logos, or branding in any manner that suggests endorsement or affiliation without prior written consent.

Toast Tours retains all rights, title, and interest in and to the Content.

PRIVACY

Any personal information collected will be handled in accordance with our Privacy Policy.

Recording & Monitoring

For safety, security, and quality assurance purposes, Toast Tours may utilize video and audio recording devices within its vehicles, as well as GPS tracking and vehicle monitoring systems.

By participating in our Services, you acknowledge and consent to such recording and monitoring.

Recorded content may be used for legitimate business purposes, including but not limited to staff training, service quality, safety review, incident investigation, and legal compliance. In the event of an accident, dispute, or legal matter, recordings may be used as evidence and may be shared with insurance providers, legal representatives, or law enforcement as required.

You acknowledge that there is no expectation of privacy within tour vehicles to the extent permitted by applicable law.

MEDIA & FEEDBACK RELEASE

By participating in a Toast Tours experience, you grant Toast Tours and its affiliates, successors, and assigns a worldwide, perpetual, irrevocable, royalty-free, fully paid, and transferable license to use, reproduce, distribute, display, publish, and create derivative works from any photographs, videos, or other media captured during your experience in which you may appear, for marketing, promotional, advertising, and business purposes, in any format or media now known or later developed, without geographic limitation.

If you do not wish to be included in such media, you must notify Toast Tours in writing prior to your tour.

You also grant Toast Tours a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, and display any reviews, testimonials, feedback, or other content you provide, including excerpts or adaptations, for marketing, promotional, and business purposes, without compensation or further approval.

To the extent permitted by law, you waive any rights of publicity, privacy, or approval related to such use.

DISPUTE RESOLUTION (ARBITRATION)

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration, rather than in court.

The parties agree to first attempt to resolve any dispute informally by contacting each other and engaging in good-faith negotiations for a period of at least thirty (30) days.

If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable rules then in effect.

Notwithstanding the foregoing, either party may bring an individual claim in small claims court where permitted by law.

The arbitration shall take place in San Luis Obispo County, California, unless otherwise agreed by the parties. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration provision.

You agree to:

  • Waive any right to a jury trial
  • Waive participation in any class action, collective action, or representative proceeding

The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Each party shall bear its own costs unless otherwise required by applicable law or determined by the arbitrator.

If arbitration is found to be unenforceable for any reason, any dispute shall be resolved exclusively in the state or federal courts located in San Luis Obispo County, California.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

CHANGES TO TERMS

Toast Tours reserves the right to update or modify these Terms at any time in its sole discretion. Any changes will become effective upon posting the updated Terms on our website, unless a later effective date is expressly stated.

The “Effective Date” indicated at the top of these Terms reflects the most recent update. It is your responsibility to review these Terms periodically. Continued use of the Services after any changes are posted constitutes your acceptance of the revised Terms.

MISCELLANEOUS

These Terms constitute the entire agreement between the parties. If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver.
