We may release your information when we deem it appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety. We will never sell or rent this information to anyone.

WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.
Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

- Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information – such as your Internet Protocol (IP) address and/or browser and device characteristics – is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
Like many businesses, we also collect information through cookies and similar technologies.
The information we collect includes:
- Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called “crash dumps”), and hardware settings).
- Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
- Location Data. We collect location data such as information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.
Google API
Our use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.
We use reCAPTCHA to help protect our website from spam and abuse. reCAPTCHA may collect device and interaction data to determine whether activity is legitimate.
Information collected from other sources
In Short: We collect limited business contact information from public sources, and contact details that referral partners provide when arranging a tour.
We may obtain information about you from sources other than you directly, in three limited circumstances:
- Business contact information published publicly. When we contact companies about corporate or group outings, we may use business contact details, such as a name, job title, work email address, and main office telephone number, published on that company’s own website or other public professional sources.
- Referral partners. When a hotel, vacation rental, concierge, winery, or other partner arranges a tour on your behalf, they may provide us with your name and contact details so that we can confirm the booking and coordinate your tour.
- Review platforms. We display reviews, including reviewer names, that guests have publicly published on platforms such as Google, Yelp, and Tripadvisor.
We do not purchase personal information from data brokers or list vendors, and we do not obtain personal information from third parties for the purpose of targeted advertising.
We never add a telephone number obtained from any third-party source to our text messaging program. Mobile numbers are used for text messaging only where you have provided them to us directly and consented as described in the “SMS and Text Messaging” section below.
Recording and Monitoring
We are dedicated to prioritizing the safety and quality of our tours. As part of our unwavering commitment to security and training, please be informed that we may engage in the recording of video and audio content within our vehicles.
This recording is expressly intended for internal use by Toast Tours LLC, encompassing, but not limited to, staff training, service quality assurance, and safety enhancement purposes. In the unlikely event of an accident or incident, we may use the recorded footage for documentation and legal purposes, including but not limited to, providing evidence in court proceedings.
HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
- To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
- To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
- To fulfill and manage your orders. We may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services.
- To enable user-to-user communications. We may process your information if you choose to use any of our offerings that allow for communication with another user.
- To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
- To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt out of our marketing emails at any time.
- To deliver targeted advertising to you. We may process your information to develop and display personalized content and advertising tailored to your interests, location, and more.
- To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.
- To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.
- To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.
- To save or protect an individual’s vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.
- To book and coordinate your itinerary. We make tasting and dining reservations on your behalf with the wineries, restaurants, and other venues on your itinerary. Most reservations are made in the name of Toast Tours. Some venues require guest contact details in order to hold a booking, and in those cases we provide your name and telephone number so that the venue can hold the reservation, identify your party on arrival, and reach you if anything changes. We also share your group size, arrival time, and any dietary restrictions or accessibility needs you have told us about. We provide your contact details so that venues can host you, not for their own marketing. Venues may hold their own records of your reservation and purchases, governed by their own privacy practices.
- To introduce you to partners you have asked to hear from. With your permission, we may share your name and email address with the wineries on your itinerary so they can send you information about their wines, events, and club offerings. This is optional, it is never a condition of booking, and you can decline it when you book or withdraw it at any time by contacting us. We do not share your mobile telephone number or your SMS consent with partners for marketing purposes.
WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?
We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.
SMS AND TEXT MESSAGING
Toast Tours LLC uses SMS text messaging to communicate with guests, prospective guests, employees, and business partners.
How we obtain your consent. We may text you if you provide your mobile number to us in one of the following ways:
- You enter it on our quote request or contact form at toasttours.com and check the box agreeing to receive text messages
- You send a text message to our business number first
- You give it to us by telephone when booking or inquiring about a tour and tell us we may text you about it
- You provide it to us in the course of your employment or business relationship with Toast Tours
We do not purchase or acquire mobile telephone numbers from data providers, marketing partners, or other third-party sources for text messaging.
Consent to receive text messages is not a condition of purchasing any goods or services from us.
What we send. Messages relate to your booking or our working relationship, and may include tour confirmations, pickup times and locations, day-of coordination, schedule or itinerary changes, and responses to your questions.
Message frequency. Message frequency varies and depends on your booking activity and your communication with us.
Cost. Message and data rates may apply. Toast Tours does not charge for text messages; charges, if any, come from your mobile carrier.
How to stop messages. You can opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from us. We will send one confirmation message and will not text you again unless you opt back in. For assistance, reply HELP or call us at (805) 400-3141.
Carriers. Carriers are not liable for delayed or undelivered messages.
We do not share mobile information. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Information sharing to subcontractors in support services, such as customer service, is permitted. Mobile numbers are disclosed to our booking platform and messaging provider solely so they can provide those services to us, and those providers are not permitted to use your number for their own marketing.
WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

Notwithstanding the categories listed above, mobile telephone numbers and SMS consent are excluded. We do not share, sell, rent, or otherwise disclose mobile telephone numbers or text messaging opt-in data to any third party, affiliate, advertising network, or marketing partner for their own marketing or promotional purposes. Mobile numbers are disclosed only to service providers acting on our behalf – including our booking platform and our messaging provider – solely to deliver services we have engaged them to perform, and those providers are prohibited from using the information for any other purpose.
We also may need to share your personal information in the following situations:
- Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
- When we use Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API). Google Maps uses GPS, Wi-Fi, and cell towers to estimate your location. GPS is accurate to about 20 meters, while Wi-Fi and cell towers help improve accuracy when GPS signals are weak, like indoors. This data helps Google Maps provide directions, but it is not always perfectly precise. We obtain and store on your device (“cache”) your location. You may revoke your consent anytime by contacting us at the contact details provided at the end of this document.
- Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.
WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?
In Short: We are not responsible for the safety of any information that you share with third parties that we may link to or who advertise on our Services, but are not affiliated with, our Services.
The Services may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us and which may link to other websites, services, or applications. Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third-party websites. Any data collected by third parties is not covered by this Privacy Notice. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions.
DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
In Short: We may use cookies and other tracking technologies to collect and store your information. While some cookies are essential or for performance and functionality, others are used for analytics, customization and advertising.
We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.
We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements, to tailor advertisements to your interests, or to send abandoned shopping cart reminders (depending on your communication preferences). The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites.
To the extent these online tracking technologies are deemed to be a “sale”/”sharing” (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by controlling the cookies in your browser.
How can I control cookies on my browser?
As the means by which you can refuse cookies through your web browser controls vary from browser to browser, you should visit your browser’s help menu for more information. In addition, most advertising networks offer you a way to opt out of targeted advertising.
What about other tracking technologies, like web beacons?
Cookies are not the only way to recognize or track visitors to a website. We may use other, similar technologies from time to time, like web beacons (sometimes called “tracking pixels” or “clear gifs”). These are tiny graphics files that contain a unique identifier that enables us to recognize when someone has visited our Website or opened an email including them. This allows us, for example, to monitor the traffic patterns of users from one page within a website to another, to deliver or communicate with cookies, to understand whether you have come to the website from an online advertisement displayed on a third-party website, to improve site performance, and to measure the success of email marketing campaigns. Do you serve targeted advertising?
Third parties may serve cookies on your computer or mobile device to serve advertising through our Website. These companies may use information about your visits to this and other websites in order to provide relevant advertisements about goods and services that you may be interested in. They may also employ technology that is used to measure the effectiveness of advertisements. They can accomplish this by using cookies or web beacons to collect information about your visits to this and other sites in order to provide relevant advertisements about goods and services of potential interest to you. The information collected through this process does not enable us or them to identify your name, contact details, or other details that directly identify you unless you choose to provide these.
Information sent to advertising platforms from our forms
When you submit a form on our website, our advertising tools may transmit a hashed (irreversibly scrambled) version of the contact information you enter, including your name, email address, and telephone number, to advertising platforms including Meta (Facebook and Instagram) and Microsoft.
We use this to measure whether our advertising is working and to show our advertisements to you and to people with similar interests on those platforms. We are not paid for this information, and we do not provide it to these platforms so that they can market their own products or services to you. Their handling of the information is also governed by their own privacy policies.
You can limit this by adjusting your advertising preferences directly with those platforms, or through your browser’s cookie controls as described above.
Google Analytics
We may share your information with Google Analytics to track and analyze the use of the Services. The Google Analytics Advertising Features that we may use include: Remarketing with Google Analytics, Google Display Network Impressions Reporting and Google Analytics Demographics and Interests Reporting. To opt out of being tracked by Google Analytics across the Services, click here. You can opt out of Google Analytics Advertising Features through Ads Settings and Ad Settings for mobile apps. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?
In Short: We may transfer, store, and process your information in countries other than your own.
Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see “WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?” above), in the United States, and other countries.

European Commission’s Standard Contractual Clauses:
We have implemented measures to protect your personal information, including by using the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.
HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We will maintain your information for our records to fulfill the purposes outlined in this Privacy Policy until you ask us to delete this information or unless otherwise required by law.
We will keep your personal information until you ask us to delete this information for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).
If deletion is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. We will consider and act upon any request in accordance with applicable data protection laws.
If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.
If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.
Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below.
However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying “STOP” or “UNSUBSCRIBE” to the SMS messages that we send, or by contacting us using the details provided in the section “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

We have collected the following categories of personal information in the past twelve (12) months:
- Category A. Identifiers: name, postal address, email address, telephone number, IP address, and similar online identifiers
- Category B. Personal information as defined in the California Customer Records law: name, address, telephone number, and payment card information

We do not collect Category E (biometric information) or Category J (education information).
Sensitive personal information
We collect sensitive personal information only where necessary to provide our Services, and only for purposes permitted by law or with your consent. For Toast Tours, this may include:
- Payment card information together with any required security code, collected and stored by our booking and payment processors
- Health-related information you choose to share with us, such as food allergies, dietary restrictions, or mobility and accessibility needs – which, depending on what you tell us, may also reveal religious or philosophical beliefs
- Precise geolocation, where vehicle location is recorded during a tour
- The contents of communications between you and Toast Tours, including text messages and recorded telephone calls
We use this information solely to deliver and support the Services you have requested, for safety and security, and to comply with law. We do not use or disclose sensitive personal information for the purpose of inferring characteristics about you, and we do not use it for advertising. You may have the right to limit our use and disclosure of your sensitive personal information.
Other information
We may also collect other personal information outside of these categories when you interact with us in person, online, or by telephone or mail, in the context of:
- Receiving help through our customer support channels;
- Participating in customer surveys, promotions, or contests; and
- Facilitating the delivery of our Services and responding to your inquiries.
How long we keep it
We use and retain collected personal information as long as necessary to provide the Services, to maintain records of your bookings, and to comply with our legal, tax, accounting, insurance, and safety obligations. Where no legal obligation requires a longer period, we retain the information until you ask us to delete it.
Sale and Sharing of Personal Information
We have not sold personal information to third parties in the preceding twelve (12) months, and we do not sell personal information.
We do “share” personal information as that term is defined under California law, which includes disclosing personal information for cross-context behavioral advertising. We do this through advertising and analytics technologies on our website, such as advertising pixels and remarketing tags, which allow our advertisements to be shown to you on other platforms. No money is exchanged for this information.
We have shared the following categories of personal information for cross-context behavioral advertising in the preceding twelve (12) months:
- Category A. Identifiers: limited to online and device identifiers such as cookie IDs, advertising IDs, and IP address
- Category D. Commercial information: limited to the fact that a booking or inquiry was completed, for advertising measurement
- Category F. Internet or other electronic network activity information
- Category K. Inferences drawn from the above
The categories of third parties with whom we shared this information are:
- Advertising networks and social media platforms
- Search and analytics providers
- Retargeting platforms
- Email and marketing software providers
Except as described under “Information sent to advertising platforms from our forms” above, we do not share, and have not shared, your postal address, telephone number, payment information, sensitive personal information, or the contents of your communications with us, with any third party for that party’s own advertising or marketing purposes.
Mobile telephone numbers and SMS consent are excluded entirely from all sale and sharing. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Mobile numbers are disclosed to our booking platform and messaging provider solely so they can provide those services to us, and those providers are not permitted to use your number for their own marketing. Separately, information submitted through our website forms is used in our own advertising as described under “Information sent to advertising platforms from our forms” above.
You may opt out of this sharing at any time. See “Your Rights” below.
Your Rights
You have rights under certain US state data protection laws. These rights are not absolute, and in certain cases we may decline a request as permitted by law. These rights include:
- Right to know whether or not we are processing your personal data
- Right to access your personal data

To exercise any of these rights – including opting out of the sale or sharing of your personal information for targeted advertising, or limiting our use of your sensitive personal information – you may:

For requests to access, correct, or delete personal information, we may need to verify your identity before responding. You may designate an authorized agent to make a request on your behalf.
You may also limit interest-based advertising directly through the advertising platforms themselves, and through your browser’s cookie controls, as described in the “Do we use cookies and other tracking technologies?” section above.
Request Verification
Upon receiving a request to access, correct, delete, or obtain a copy of your personal information, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We do not require identity verification, an account, or any additional information in order to process a request to opt out of the sale or sharing of your personal information. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.
If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.
Appeals
Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at info@toasttours.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.
California “Shine The Light” Law
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
